Woman sues Yankees for $10M after getting struck by bat, says she suffered brain injury



A New Jersey woman is suing the New York Yankees for $10 million after a bat flew into the stands and struck her in the head, which she says gave her a brain injury.

According to the complaint filed on Aug. 1, Stephanie Duluc says she was attending the June 2 game at Yankee Stadium where the Cleveland Guardians were playing the Yankees.

Duluc, 37, received seats behind home plate, attending as a guest with her employer, the complaint says. During the game, a Guardians player lost control of his bat, sending it flying into the stands, where it struck Duluc in the head and hands.

The incident was captured live on YES Network and showed Duluc getting knocked down before eventually getting back to her feet, according to the complaint.

Despite netting being installed in front of the plaintiff’s seating section, the lawsuit says a gap was left open above the section where the bat entered the stands, and that the netting was “materially lower” than the netting protecting adjacent stands.

The complaint alleges that the injuries sustained by Duluc were directly due to negligence regarding the height of the netting.

Duluc, a senior health care executive, suffered a traumatic brain injury and she has been unable to return to her professional role, the complaint says.

The New York Yankees did not immediately respond to an NBC News request for comment.

The lawsuit requests damages of $10 million for past and future physical injuries, pain and suffering, emotional distress, and loss of enjoyment of life. Additionally, it would be covering any past and future medical and rehabilitation expenses and lost earnings.
