Europe's regulatory double bind



The European Union’s AI Act – the world’s most ambitious regulatory framework for artificial intelligence to date – was supposed to enter into full effect on 2 August 2026. But while the AI Act’s transparency layer has come into effect, obliging providers to inform individuals when they interact with an AI system, its high-risk regime – covering biometric identification, recruitment systems, credit scoring, law enforcement, and border control – has been delayed. This column argues that the result is a double bind in which Europe loses regulatory sovereignty whether it enforces its own rules or retreats from them.
