Last week, Rockstar Games’ parent company Take-Two were filed subpoenas asking for info from Microsoft and Discord to help uncover the identity of the hacker or hackers behind the ongoing GTA 6 leaks. With clips of the game continuing to hit the net and the potential threat of story spoilers starting to drop soon, it was an understandable request for the company to have made, even if questions could be raised about the amount of data it might give them access to.

One of the two companies subpoenaed, Discord, have now said that as of last night they’ve yet to be served with any subpoena from Take-Two, and that if/when they are, they’ll not comply without first considering the ramifications of doing so.

“I can share an update on this: Discord has not yet been served with a subpoena from Take Two,” the social platform’s marketing director Ryan Rigney wrote in a tweet posted on August 24th. “When we do, we’ll evaluate the validity and scope before responding.”

Microsoft have already indicated their willingness to aid in Take-Two’s efforts to hunt down the leaker/leakers. “We are working closely with Take-Two and Rockstar Games to support efforts to protect creative works and intellectual property,” Xbox chief technology officer Scott Van Vliet posted last week.

As part of the subpoenas, Discord have reportedly been asked for “all identifying information associated with all user accounts that are/were members” of a specific list of servers between June 1st and now. Take-Two are seeking info like account IDs, registration emails, registration and last-login IP addresses, phone numbers, linked connections like Google or Xbox, any associated device identifiers, and any content related to Grand Theft Auto, Rockstar or Cyberleek on OneDrive accounts.

Since that list emerged, concerns have been raised online about the broadness of Take-Two’s request and the sheer volume of data about people not linked to the source of the leaks that it could put into their hands. The post Rigney replied to with his update expressed exactly those sorts of worries.

As Kotaku point out, Microsoft have far more of an obvious vested interest in staying in Take-Two’s good books by helping out than Discord. The latter have previously faced subpoenas from game companies like Nexon over alleged hosting of communities dedicated to piracy and has taken down servers related to Switch emulators in response to legal action from Nintendo.

Given the company’s differing responses to those two cases, it’s tough to say how they’ll opt to treat Take-Two’s subpoena. Unless there’s a clear legal reason to refuse, my hunch would be that the company will end up going along with it in some form.
