SCOTUS takes up Trump birthright citizenship case


The Supreme Court said Friday that it would hear an expedited appeal of President Donald Trump’s case seeking to end birthright citizenship by executive order. 

The Supreme Court did not explain the decision. It will likely be scheduled for oral argument next spring and decided by the end of June.

This is the second time Trump’s order will come before the court, but this time the justices are expected to review it on the merits.

For more than 100 years, courts and the government have interpreted the Constitution to give U.S. citizenship to anyone born on American soil — regardless of the legal status of the child’s parents.

Upon taking office for a second term, Trump signed an executive order seeking to discontinue that practice and limit citizenship only to children born to parents who are legal permanent residents or citizens.

Federal courts of appeals have blocked Trump’s order nationwide finding it unlawful at first look.
